3. How to Submit a Takedown Notice
To submit a copyright takedown notice, please send a written notice to the address above containing the following information:
- A physical or electronic signature of a person authorised to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material.
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
4. Counter-Notice Process
If you believe that material you submitted has been removed or disabled as a result of mistake or misidentification, you may send a counter-notice to our designated agent containing:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts of England & Wales.
5. Repeat Infringer Policy
In accordance with the Digital Millennium Copyright Act (DMCA) and analogous UK legislation, UniStream maintains a policy of terminating, in appropriate circumstances, the accounts of subscribers who are repeat infringers of intellectual property rights. We reserve the right to terminate access without refund for users found to have repeatedly infringed the intellectual property rights of third parties.
6. Abuse of Process
Submitting a knowingly false or misleading takedown notice or counter-notice may give rise to civil liability. We reserve the right to seek damages from any party that abuses this process.
